Informal and Formal Complaint Resolution

If you decide you would like to report an incident to the University, informal or formal complaint resolution processes in the Sexual and Interpersonal Misconduct Policy may be available to address sexual or interpersonal misconduct.  Informal resolution might not involve a full investigation or in most cases a disciplinary outcome, while formal resolution would include a full investigation with possible hearing and disciplinary outcomes. You can also seek assistance from Drake University without engaging in any type of complaint resolution.

The Title IX Coordinator or Dean of Students are available to discuss these processes with students.  The Title IX Coordinator and Director of HR Partner Services are available to discuss these processes with faculty or staff.

Step-by Step: 
Formal Student Complaint Resolution Process

If you decide to file a formal complaint against a student, the Dean of Students Office follows Section III of the University's Code of Student Conduct for investigating and processing complaints. The following information is a summary of the resources, process, and procedures, but please refer to the Code of Student Conduct and the Sexual and Interpersonal Misconduct Guidelines and Contacts for the full, applicable investigatory and resolution process.

The Title IX Coordinator is able to explain these processes as well if you have questions. 

Advisor/Support Person

Throughout the investigation and resolution process, both students involved may have an advisor, advocate, or support person of their choice in meetings, interviews, or hearings.  When choosing an advisor or support person, please choose someone who will not also be involved in the matter as a witness.  Additional information regarding the selection and role of an advisor or support person can be found in the Sexual and Interpersonal Misconduct Guidelines and Contacts.

Interim Measures

The University will work with any student to make available assistance within the educational, housing, and/or work environment. Safety planning and University no-contact orders are also available through interim measures.  Interim measures are not disciplinary actions.

Investigation

University investigator(s) will meet with each student separately as well as other witnesses and review evidence.  Each student will have an opportunity to review the investigation report before it goes to the Dean of Students, who is the decision maker.

Hearing

Dean of Students will hold a hearing before making a final decision and imposing discipline, if applicable.  Both students may participate - arrangements can be made to prevent direct contact.

Notice of Decision
Dean of Students determination of whether there is a reasonable belief the charges can be proven based on standard of “preponderance of the evidence,” i.e., whether it is more likely than not that the policy was violated, not criminal standard of “beyond reasonable doubt.” Either student may appeal.

Potential Outcomes

(1) No reasonable belief the charges can be proven. Complaint will be closed. Protective measures are still available.

(2) Reasonable belief the charges can be proven, appropriate sanctions. 

Resolution by Agreement
Voluntary process where either student may seek to resolve a complaint through the dean of students (not through the other student) rather than completing the formal complaint resolution process. Both students will have input in any outcome.

Potential Sanctions

Under the Code of Student Conduct: expulsion, suspension, probation, removal from Drake housing, counseling, non-academic probation, revocation of privileges, restitution, fines, or reprimand.
