When a complaint of sexual misconduct (e.g., sexual harassment, sexual violence, sexual assault or sexual exploitation) or interpersonal misconduct (e.g., domestic violence, dating violence or stalking) is investigated and adjudicated through a University policy, sanctions are available if the respondent is found to be responsible for the alleged misconduct.
Sanctions issued will depend on the circumstances of each case and are at the discretion of the decision maker. Certain factors, when present, may lead to more severe sanctions. These include:
For complaints against students, the Code of Student Conduct identifies possible sanctions, including expulsion, suspension, non-acdemic probation, removal from University-owned housing, mandatory counseling, revocation of privileges, restitution, fines, educational or work assignments, or University reprimand.
For complaints against employees, sanctions could range from counseling and reprimands to suspension or termination from employment.
For complaints involving third parties, the University may not have authority to sanction, but the University can take steps aimed at stopping the behavior and preventing its recurrence on campus or through Drake programs or activities.
The University may also implement non-disciplinary Supportive Measures when appropriate and reasonable once it is notified of sexual and/or interpersonal misconduct, which may include no-contact orders and/or temporary or permanent changes in housing, academic, transportation and working conditions, if requested and reasonably available. These can be implemented before, during, or after an investigation or adjudication process or even if a formal report is never filed with the University.
